Form W-8BEN-E
The IRS form a non-U.S. legal entity gives to a U.S. payer to certify foreign status and claim treaty benefits.
Form W-8BEN-E is the entity-level counterpart to Form W-8BEN. It is filed by foreign LLCs, corporations, partnerships, and trusts to certify non-U.S. status and claim treaty positions on U.S.-source payments. The form runs eight pages and requires identifying the entity's FATCA classification (Active NFFE, Passive NFFE, etc.), which most non-resident LLCs misclassify on the first attempt. The form is given to the U.S. payer, valid for three calendar years.
